HOMES.COM 2024 MEN’S COLLEGE BASKETBALL CHALLENGE

OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. Subject to federal, state, and local laws, regulations, and ordinances. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military Installations located in foreign countries, and where prohibited by law. The Homes.com 2024 Men’s College Basketball Challenge (the “Challenge”) will commence at 12:00:00 A.M. Eastern Standard Time on March 28, 2024 and end at 11:59:59 P.M. Eastern Standard Time on April 5, 2024 (the “Challenge Period”). The Challenge will be divided into three Rounds being Round A: Sixteen (16) teams to eight (8) teams, Round B: eight (8) teams to four (4) teams, and Round C: four (4) teams to two (2) teams to one (1) team. The Sponsor of this Challenge is CoStar Realty Information, Inc. (“CoStar” or “Sponsor”), 1331 L Street, NW, Washington, DC 20005. Participation constitutes entrant’s full and unconditional agreement to these Official Rules, which are final and binding in all matters related to the Challenge.

THIS CHALLENGE IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH ANY SOCIAL MEDIA PLATFORM INCLUDING WITHOUT LIMITATION TWITTER, TIKTOK, PINTEREST, LINKEDIN, OR FACEBOOK OR INSTAGRAM FROM META (“SOCIAL MEDIA PLATFORM(S)”). THIS CHALLENGE IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH THE NATIONAL COLLEGIATE ATHLETIC ASSOCIATION.

ELIGIBILITY: This Challenge is a trade promotion that is open only to licensed real estate agents. The Challenge is open to legal U.S. residents currently residing in the 50 United States and the District of Columbia who are eighteen (18) years of age or older as of the date of entry (“Participants”). Employees, officers, and directors of Sponsor or Sponsor’s parents, affiliates, subsidiaries, representatives, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Employees, officers and directors of competitors of Sponsor or Sponsor’s affiliates are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of winners.

HOW TO ENTER: To enter, Participants must complete the entry form that is available on Sponsor’s website here: homes.com/solutions/varsityjacket. Participants may receive an email containing the website link or access it via Sponsor’s social media profiles. In addition to providing contact information, Participants will be asked to predict the 2024 National Collegiate Athletic Association men’s basketball tournament winner, and the score in the championship game. Each Participant may submit only one (1) entry per Round into the Challenge with such entry being applied to the then applicable Round.For the avoidance of doubt, entries submitted during an active Round will be applied to the then following Round, if any. Participants who submit more than one (1) entry per Round into the Challenge may be disqualified at Sponsor’s sole discretion. The potential winner is subject to verification before any prize is awarded and may be required to show proof of meeting all eligibility requirements. Sponsor is not liable for lost, late, misdirected, or corrupted entries whether due to a technical error or otherwise. Entries become the property of Sponsor and will not be acknowledged or returned. Sponsor shall have the sole discretion to determine the validity of an entry. Automated or bulk entries or entries submitted by third parties will be disqualified. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified.

PRIZE SELECTION: Promptly following the conclusion of the Challenge Period, each Round’s potential winner who correctly predicted the winning team and the game score will be selected by Sponsor from among all eligible entries to receive the Prize described below. If no Participants correctly predicted the winning team and the correct game score, the Participant who correctly predicted the winning teams and was closest to the correct game score among all eligible entries will be declared the potential winner. If multiple Participants correctly predict the winning team and the game score, eachsuch Participant will be selected as a potential winner to receive the Prize. The potential winner(s) will be notified during the week of April 8, 2024. The odds of winning depend on the number of eligible entries received during the Challenge Period.

Prior to being confirmed as a Winner, the potential winner(s) will be required to sign and return an Affidavit or Declaration of Eligibility and Liability/Publicity Release within two (2) days of notification.If the potential winner(s) fails to respond within two (2) days of notification, fails to return a winner’s release/affidavit, or is disqualified for any reason, Sponsor retains discretion to award the Prize to an alternate winner selected from all remaining eligible entries, time permitting. Upon Prize forfeiture, no compensation will be given. The potential winner must continue to comply with these Official Rules and winning is contingent upon fulfilling all requirements.

PRIZE: Each Winner will receive one (1) “Homes” varsity-style jacket similar to the jacket worn by actors in the Homes.com 2024 campaign commercials. Total Prize ARV: $600. Prize value includes cost of shipping to winner’s residence. By accepting any prize, the Winner grants permission to Sponsor to use winner’s name, voice, likeness, entry submission and statements for publicity purposes without further compensation, consideration or consent, except where prohibited by law. Winner represents and warrants that it has obtained or will obtain all necessary and appropriate permissions to allow Sponsor and its representatives to provide it with the prize. The Prize is not negotiable with the Winner. The Prize isnon-transferable, and no substitutions are allowed except by Sponsor who may award a prize for one of equal or greater value for any reason. Winner is solely responsible for all applicable federal, state and local taxes and fees, including income or local personal property taxes, insurance, licensing, registration and title fees arising out of the receipt and use of the Prize. Any difference between the stated estimated value of a prize and its actual value will not be awarded.

SPONSOR’S RIGHTS. Participation in Challenge constitutes Participant’s grant to Sponsor and itspartners and designees, the irrevocable and perpetual nonexclusive right to use, publicly display, print, publish, reproduce, distribute, modify, create derivative works from, and provide access to each Participant’s entry submission, name, address (city and state/province/territory), likeness, photograph, picture, portrait, voice, opinions, biographical information and/or any statements made by Participant’sregarding the Challenge or the Prize(s) for advertising and promotional purposes without limitation, in any media, worldwide, without notice or additional compensation or consent, except where prohibited by law. If a Participant chooses to submit or post any media content (including to but not limited to photographs, videos, recordings) in connection with this Challenge, that Participant grants to Sponsor, itspartners and designees, a worldwide, royalty-free, perpetual, non-exclusive right and license to use, reproduce, copy, distribute, and display each submitted entry and any part thereof, in any media, and the right to use, copy, modify, edit, and create derivative works therefrom, and agrees to execute documents confirming such right and license at Sponsor’s reasonable request.

GENERAL CONDITIONS. This Challenge is governed by the laws of the United States. IF, FOR ANY REASON, THE CHALLENGE IS NOT CAPABLE OF RUNNING AS PLANNED, SPONSOR RESERVES THE RIGHT AT ITS SOLE DISCRETION TO CANCEL, TERMINATE, MODIFY OR SUSPEND THE CHALLENGE AT ANY TIME WITHOUT NOTICE OR OBLIGATION. SPONSOR SHALL NOT BE RESPONSIBLE FOR ANY INCORRECT OR INACCURATE INFORMATION, INCLUDING, WITHOUT LIMITATION, ANY TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE PROCESSING OF SUBMISSIONS IN THE CHALLENGE. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermining the entry process or the legitimate operation of the Challenge or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. By participating in the Challenge, all Participants agree that the state and federal courts located in the District of Columbia shall have exclusive jurisdiction over claims arising out of the Challenge and matters related thereto, and that all Participants agree to the venue and jurisdiction of such District of Columbia courts.

RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Challenge, Participants agree to release and hold harmless Sponsor, all Social Media Platforms, their subsidiaries and affiliates, and all of their officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Challenge or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Challenge; (b) errors on Sponsor’s website; (c) lost, delayed, postage-due, misdirected, or undeliverable communications; or (d) errors in the administration of the Challenge or the processing of entries. Participants agree that Sponsor, its parents, affiliates, subsidiaries, retailers, distributors, advertising and promotion agencies, suppliers, and those acting pursuant to its authority shall have no liability whatsoever for, and will be held harmless by Participants, against any liability for any injuries, losses, or damages of any kind to Participants or any other person or entity, including personal injury or death to winner or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize, entry, or participation in this promotion or in any promotion-related activity, or any claims based on publicity rights, defamation, or invasion of privacy or merchandise delivery. Participant further agrees that, to the extent permitted by law, in any cause of action, Sponsors' liability will be limited to the cost of entering and participating in the Challenge, if any, and in no event shall the Sponsor be liable for attorney's fees. Without limiting the foregoing, everything regarding this Challenge, including the web site and any prize, is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

PRIVACY: Information collected from Participants is subject to Sponsor’s Privacy Policy which can be found at https://www.homes.com/about/policies/. By entering this Challenge, you agree to the use of your personal information as described in the above Privacy Policy.
